The insurance world is in uncharted territory in the face of an unprecedented global pandemic, and it is far from clear at this point in time exactly how different types of policies will respond to these novel circumstances.  Many sources have predicted that it is unlikely that losses as a result of partial or complete business shutdowns due to the Coronavirus/COVID-19 pandemic will be covered.  In fact, insurance companies have already begun denying these claims or reserving their right to do so in the future.  There are a number of reasons for this, but coverage in each case ultimately depends on a variety of factors, including the specific facts of the claim and the language of the applicable insurance policy.

 

You may also have heard of proposed legislation that, if passed, would force insurance companies to pay certain types of COVID-19 related claims retroactively.  We are closely monitoring these legislative developments, but to date, none of this proposed legislation has moved forward.

 

Nevertheless, if you believe your business has suffered a loss due to the Coronavirus/COVID-19 pandemic, submit a claim to your insurance carrier in order to protect your rights under your policies.  You may provide basic information to us by completing this Loss Report about any claim you would like us to submit on your behalf, and our claims advocates will be happy to assist you.
